Justice Tsoho rejects Nyako’s decision on recusal from Kanu’s case<\/p>\n
The Chief Judge of the Federal High Court of Nigeria, Justice John Tsoho, has rejected the recusal request of the detained leader of the Indigenous People of Biafra, Nnamdi Kanu, seeking reassignment to another judge for his trial.<\/p>\n
At the hearing on September 24 regarding the seven-count terrorism charges brought against him by the Federal Government, Kanu expressed a loss of confidence in the trial judge, Justice Binta Nyako, and requested her recusal.<\/p>\n
Justice Nyako agreed to the request and stated she would send Kanu\u2019s case file back to the Chief Judge for reassignment.<\/p>\n

However, Justice Tsoho returned Kanu\u2019s case file to Justice Nyako, noting that two other judges had previously been recused from the case.<\/p>\n

He explained that Kanu\u2019s case had been reassigned to Justice Nyako due to its prolonged nature, dating back to 2015. Since she had been handling the case for most of that time, she was deemed the most suitable judge to see it through to a conclusion.<\/p>\n

Justice Tsoho further stated that if Kanu insists on recusing Justice Nyako at the next hearing, he must file a written motion on notice, along with an affidavit detailing the grounds for his request.<\/p>\n

\u201cNnamdi Kanu must also serve it on the prosecution team and appear before Justice Nyako for her review and determination, after which she can make her decision,\u201d he said.<\/p>\n

Kanu\u2019s counsel, Aloy Ejimakor, confirmed the development, adding that Kanu\u2019s team is awaiting an official notice from the court and a new hearing date.<\/p>\n","protected":false},"excerpt":{"rendered":"
